A few small- and medium-sized business owners in New York recently filed a lawsuit to fight against a law that prevents them from charging customers more for using credit cards. Bloomberg reports that five establishments, including a hair salon and an ice cream parlor, entered the complaint to have the regulation declared unconstitutional.

The heart of the matter is that SMBs are charged for accepting credit payments and lose money from the transactions. The plaintiffs also believe that the law prevents "consumers from understanding the costs of swipe fees."

Small- and medium-sized business owners have been lacking confidence in recent months because outside forces have negatively affected their companies, but a new report shows that optimism is trending upward. The National Federation of Independent Business' Index of Small Business Optimism increased by 2.3 points in May to reach 94.4 for the month's total. This is the second-highest rating since December 2007 when the recession began. Bill Dunkelberg pointed out that this might not be indicative of sweeping confidence. 

"It's nice to see confidence not shrinking, but there isn't much to hang your hat on in this report. We are back to where we were in May 2012. Two good months don't make a trend, but we can't have a trend without them, so it's a start," said Dunkelberg. 

Moreover, there were some concerning statistics in the NFIB's latest index. The Huntsville Times reports that job creation remained "flat after five months of increases," showing that some SMB owners are struggling to expand. 

Overall, the index shows that entrepreneurs believe conditions are improving for independent companies. If the upward trend remains stable for the next few months, it might indicate that SMB owners are confident that the economy has recovered.

Small- and medium-sized businesses don't unanimously agree that Facebook is an effective marketing tool. Over the last few years, the social network has become a fixture in many advertising strategies, but now some entrepreneurs believe that other resources offer greater outreach to the public. For instance, Bethany Gonzalez Moreno, founder of B. EcoChic, recently started focusing more heavily on her own site than on her company's Facebook profile.

"We're keeping our page up, but we only update it occasionally with major news and have not spent a lot of time trying to build a large presence. I think the time is better spent getting great content up on our website," Moreno told PCWorld. 

Others still think that Facebook can be a valuable resource. USA Today reports that Jeff Glass, who owns Rider Shack with his wife, believes that new tools like Graph Search and Promoted Posts have improved lead generation on the social network. According to Glass, the key to SMB marketing on Facebook is consistent activity. 

"You need active involvement," he said.

The Federal Reserve Bank of New York recently found that limited access to credit is preventing many small- and medium-sized businesses in New York, New Jersey and Connecticut from growing. According to the reserve's Small Business Credit Survey, 49 percent of respondents stated that finances are hamstringing growth. Additionally, 66 percent of owners claimed they were already in the red, but 36 percent of profitable companies also said they couldn't obtain credit. 

The poll shows that 63 percent of credit applications were approved this year, which is consistent with 2012's rate. Additionally, more SMBs "received all of the credit they sought" in 2013 than they did last year. 

Most importantly, the reserve's survey shows that optimism is growing among SMBs in these three states, as only 18 percent of respondents were discouraged and didn't apply for credit, down from 29 percent in 2012. The report indicates that the owners of these companies are more likely to use their personal money as capital than other entrepreneurs are. 

Overall, the reserve's findings show that obtaining capital remains one of the toughest challenges that SMBs face in today's economy. Many owners struggle to find financial institutions that are willing to finance independent companies.

Small- and medium-sized business borrowing decreased for the third consecutive month in March. The Thomson Reuters/PayNet Small Business Lending Index dropped to 98.5 from February's 105.4. The latter statistic was "upwardly revised" from 101.3 in the initial report. The consistent drop in borrowing has negated the momentum established when the Federal Reserve began purchasing assets to bolster economic growth. PayNet founder Bill Phelan believes that entrepreneurs are struggling with the unstable market.

"They don't have an appetite to take risk...they must have an opinion that the risks are too great," Phelan told the news source.

Additionally, the index shows that SMB owners are struggling to pay off their debts. Delinquencies rose to 1.6 percent, which marks the first time in three years that the rate increased. In February, delinquency reached a record low of 1.58 percent.

These figures highlight the financial struggles many SMB owners have been facing in recent months. Entrepreneurs are trying to stretch their budgets and avoid taking on extra debt because the economy has been slow to return to pre-recession heights. The index is usually indicative of quarterly trends so borrowing may continue to decrease in the near future.
